Abstract Do inferior courts play a meaningful role in interbranch disputes between the judicial and other branches? In conflicts involving judiciary, lower move first may shape direction of conflict before high intervene directly. This paper explores how this organizational feature affects judiciary’s ability willingness to constrain branches, developing formal model an dispute hierarchical branch. The demonstrates multiple mechanisms through which court decisions alter outcomes when will initiate with branches.
